1. Acceptance of Terms
By accessing or using Epok ("the Service"), operated by Jyngle Technologies Pvt. Ltd. ("we", "us", "our", "the Company"), a company incorporated in Bangalore, India, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Epok is a log intelligence platform that provides log ingestion, storage, anomaly detection, alerting, and search capabilities. We may update, modify, or discontinue features at any time.
3. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials, including API keys. You are responsible for all activity that occurs under your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Transmit malware, viruses, or other harmful code through the Service
- Resell or redistribute access to the Service without our written consent
5. Data and Privacy
You retain ownership of all log data you send to Epok. We process your data solely to provide the Service. See our Privacy Policy for details on how we handle your data.
6. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for any data loss resulting from service outages or disruptions.
7. Data Retention
Log data is retained according to your plan's retention period. When data reaches the end of its retention window, it is automatically and permanently deleted. We do not provide recovery of expired data.
8. Payment and Billing
Paid plans are billed monthly. Usage beyond your plan's limits may result in additional charges or throttling, depending on your plan configuration. You may cancel at any time; access continues through the end of your billing period.
9. Third-Party Open Source Software
The Service incorporates third-party open source software components, including but not limited to PostgreSQL, FastAPI, and other libraries. These components are subject to their own license terms. Epok is not affiliated with, endorsed by, or sponsored by the maintainers of any third-party open source project used in the Service. All trademarks and product names are the property of their respective owners.
10. Indemnification
You agree to indemnify, defend, and hold harmless Jyngle Technologies Pvt. Ltd., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Jyngle Technologies Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. The courts of Bangalore, Karnataka, India shall have exclusive jurisdiction over any disputes arising from or relating to these Terms or the Service.
13. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat of arbitration shall be Bangalore, India. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties. The language of arbitration shall be English.
14. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
